Agreement to These Terms

If you use our services on behalf of a company or other entity, you represent that you have authority to bind that organization to these Terms.

GetQLeads Services

GetQLeads provides lead-generation and related customer-acquisition services for businesses seeking potential customers.

Services may include campaigns in industries such as:

• Other approved verticals or custom campaigns

Available campaigns, targeting options, lead characteristics, volume, delivery methods, and other specifications may vary.

GetQLeads may accept or decline campaign requests at its discretion.

Customer Eligibility

GetQLeads services are intended primarily for legitimate businesses and authorized business representatives.

By using our services, you represent that:

• You have legal authority to enter into agreements for the business you represent
• Your business operates lawfully
• You will use lead information only for legitimate business purposes
• You will comply with laws and regulations applicable to your business and outreach
• Information you provide to GetQLeads is accurate and not misleading

We may request information regarding your business, services, licensing, compliance practices, or intended use of leads before accepting or continuing a campaign.

Campaign Terms

A lead campaign may be subject to specifications agreed between GetQLeads and the customer.

Campaign specifications may include:

• Estimated or requested volume
• Delivery method
• Campaign duration
• Pricing
• Payment terms
• Replacement or credit rules
• Exclusivity or sharing status, where applicable

Campaign-specific agreements, insertion orders, invoices, written proposals, or other mutually agreed terms may supplement these Terms.

If campaign-specific terms directly conflict with these Terms, the campaign-specific terms may control with respect to that particular campaign to the extent stated in the applicable agreement.

Lead Delivery and Quality

A "lead" is a potential business opportunity containing information associated with an individual or prospective customer relevant to the applicable campaign.

Lead characteristics differ depending on the campaign.

Customer results may depend on many factors outside GetQLeads' control, including:

• Speed of follow-up
• Sales process
• Contact strategy
• Pricing
• Eligibility requirements
• Customer service
• Market conditions
• Competition
• Consumer circumstances

GetQLeads does not guarantee conversion rates, revenue, return on investment, closing rates, customer acquisition costs, or financial results.

Buyer Responsibilities

Customers receiving leads are independently responsible for how they use those leads.

You agree to:

• Use leads solely for legitimate business purposes related to the applicable campaign
• Maintain appropriate safeguards for personal information
• Restrict access to lead data to appropriate personnel and systems
• Avoid deceptive, fraudulent, abusive, or misleading communications
• Respect consumer requests to stop communications where applicable
• Maintain required licenses, registrations, approvals, or permissions for your business
• Ensure your salespeople, vendors, contractors, agents, and systems comply with applicable rules

Unless expressly permitted in writing, you may not resell, redistribute, publish, transfer, sublicense, or provide purchased lead information to unrelated third parties.

Compliance with Applicable Law

Customers are responsible for determining which laws, regulations, licensing obligations, marketing rules, privacy requirements, and industry standards apply to their business and use of lead information.

Depending on the method and nature of communication, applicable requirements may relate to:

• Telephone calls
• Text messages
• Email marketing
• Privacy and personal information
• Consumer protection
• Advertising
• Financial products and services
• Debt-related services
• Credit-related services
• Do-not-contact requests

You may not rely on GetQLeads' delivery of a lead as a representation that every possible method of contacting that lead is legally permissible under all laws or circumstances.

Pricing and Payment

Pricing is determined according to individual campaigns and is not required to be published on the GetQLeads website.

Customers will be informed of applicable pricing, payment structure, and other commercial terms before the relevant campaign is activated.

Depending on the campaign, payment arrangements may include prepaid lead purchases, deposits, campaign budgets, invoices, recurring arrangements, or other agreed structures.

You agree to pay all amounts properly due under the applicable campaign terms.

Taxes, fees, or other charges may apply where required by applicable law or agreement.

Failure to make required payments may result in campaign suspension, cancellation, withholding of future lead delivery, or other remedies available to GetQLeads.

Lead Credits, Replacements and Refunds

Eligibility for lead credits, replacements, or refunds depends on the terms of the applicable campaign.

Unless otherwise agreed in writing, a lead is not automatically considered invalid merely because:

• The individual does not answer
• The individual does not return a call
• The individual declines the service
• The individual fails to enroll
• The individual does not qualify under the buyer's internal criteria
• The buyer does not close the sale
• The lead does not generate revenue

Campaign-specific invalid lead criteria may be established separately and may include documentation requirements, reporting windows, or other conditions.

GetQLeads may reject credit or replacement requests that do not meet applicable campaign criteria.

Prohibited Uses

You may not use the website, services, or lead information for unlawful, fraudulent, deceptive, abusive, or unauthorized purposes.

Prohibited conduct includes:

• Misrepresenting your identity or business
• Using leads for scams or fraudulent schemes
• Harassing or threatening consumers
• Sending communications prohibited by applicable law
• Accessing or attempting to access systems without authorization
• Scraping, copying, or extracting website data in an unauthorized manner
• Interfering with website or service functionality
• Introducing malicious software or code
• Selling or distributing lead data contrary to campaign restrictions
• Using data for purposes unrelated to the campaign for which it was provided

Intellectual Property

GetQLeads.com, its branding, site design, text, graphics, software, interfaces, documentation, and other proprietary materials are owned by or licensed to GetQLeads unless otherwise stated.

These Terms do not transfer ownership of GetQLeads' intellectual property to customers or website visitors.

You may not reproduce, publish, distribute, modify, sell, license, create derivative works from, or commercially exploit proprietary GetQLeads content without permission.

Disclaimers

To the extent permitted by applicable law, the website and services are provided on an "as available" basis.

GetQLeads does not warrant that:

• Every campaign will achieve a particular volume
• Leads will always be available in every market
• Every lead will be reachable
• Every lead will meet a customer's internal sales criteria
• Any specific conversion rate will be achieved
• A campaign will produce any particular amount of revenue or profit
• Website or service access will always be uninterrupted

Business decisions made using leads or information provided through our services remain the responsibility of the customer.

Limitation of Liability

To the maximum extent permitted by applicable law, GetQLeads will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to use of the website, services, campaigns, or leads.

This may include, where legally permitted, loss of profits, revenue, business opportunities, goodwill, anticipated savings, data, or other economic losses.

To the extent a limitation of liability is enforceable, GetQLeads' aggregate liability arising from a particular campaign will not exceed the amount paid by the customer to GetQLeads for the portion of the service giving rise to the claim during the applicable period, unless a different limitation is agreed in writing.

Some jurisdictions may not permit certain liability limitations. In such cases, limitations apply only to the extent permitted by law.

Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless GetQLeads and its owners, affiliates, representatives, contractors, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from or relating to:

• Your misuse of lead data
• Your communications with leads or consumers
• Your products or services
• Your violation of applicable law
• Your breach of these Terms
• Your breach of campaign-specific terms
• Misconduct by your employees, contractors, vendors, or agents

Suspension and Termination

GetQLeads may suspend, restrict, or terminate a campaign or access to services where reasonably appropriate.

Reasons may include:

• Non-payment
• Suspected fraud
• Misuse of lead information
• Consumer complaints
• Regulatory concerns
• Violation of these Terms
• Violation of campaign requirements
• Risk to consumers, GetQLeads, or third parties

Termination does not eliminate payment obligations or other responsibilities that arose before termination.

Changes to These Terms

GetQLeads may update these Terms from time to time to reflect changes to services, business practices, technology, or applicable requirements.

When updated, the "Last Updated" date shown at the top of this page will be revised.

Continued use of the website or services after updated Terms become effective may constitute acceptance of the updated Terms where permitted by law.

General Terms

Entire Agreement

These Terms, together with applicable campaign agreements, policies, proposals, invoices, or other written terms, constitute the applicable agreement between GetQLeads and the customer regarding the relevant services.

Severability

If a provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain effective to the extent permitted by law.

No Waiver

Failure by GetQLeads to enforce a provision of these Terms does not constitute a permanent waiver of that provision or other rights.

Assignment

Customers may not assign or transfer their rights or obligations under a campaign without appropriate authorization from GetQLeads.

Governing Law

The governing law, venue, dispute-resolution process, and any arbitration terms, if applicable, may be established in the agreement governing the applicable customer relationship.
